Senate Bill 1294 (Chapter 2008-150, Laws of Florida) was passed during the 2008 Florida legislative session. The law becomes effective July 1, 2008. On that date, the law requires a $100 fee for verification that an activity is exempt from regulation under Section 403.813, Florida Statutes (F.S), Section 373.406, F.S., Rule 40C-4.051, Florida Administrative Code (F.A.C.), Rule 40C-42.0225, F.A.C, or Rule 40C-44.051, F.A.C. These statutory and rule provisions contain exemptions from the permitting programs developed pursuant to Part IV of Chapter 373, F.S. (Environmental Resource Permits/Stormwater Permits). Anyone requesting such an exemption verification from the District after June 30, 2008, must pay $100 when making the request for verification. During the summer of 2008, the District will begin rulemaking to address all fees related to the environmental resource permitting program. The $100 exemption verification fee may increase as a result of that rulemaking, which is expected to conclude before December 2008.
