Factors that may affect issuance of a well construction permit
Issuance of a water well construction permit by the St. Johns River Water Management District or appropriate delegated authority authorizes a licensed well contractor of record to perform a specific type of well work (construction, repair, modification or abandonment) for the permit holder (property owner).
Permit issuance can be delayed, or on rare occasion, be denied, based on one or more of the following factors:
- A complete and accurate permit application has not been submitted to the district or appropriate delegated authority. An application must be on the statewide water well permit application form and include: permit application fee, appropriate site plan, other supporting information, and the signature of the licensed water well contractor who will be constructing the well and the signature of the property owner or the owner’s agent. The application must be administratively and technically complete prior to permit issuance.
- The proposed well location does not meet the required setback distance to one or more sanitary hazards, requiring the proposed well to be relocated, or requiring the owner to apply for and obtain a variance to the setback distance(s) prior to permit issuance. The Florida Department of Health (FDOH) reviews all variance requests for proposed potable wells (private, multi-family, or limited use public water systems) that cannot meet the required setback distance to one or more sanitary hazards. The district reviews all variance requests for proposed nonpotable wells (irrigation, open-loop and closed-loop geothermal systems) that cannot meet the required setback distance to one or more sanitary hazards.
- The proposed well work will not meet the minimum construction, repair, modification, or abandonment standards of Chapters 40C-3 and 62-532, Florida Administrative Code (F.A.C.), requiring the owner to petition for and obtain a variance to the applicable standards prior to permit issuance. The district is the reviewing agency for all requests to deviate from the minimum construction, repair, modification, or abandonment standards of Chapters 40C-3 and 62-532, F.A.C.
- A new or replacement well is proposed on property that has a consumptive use permit (CUP), and the use of this well is not authorized under the current CUP. The CUP must be modified to add this well to the CUP prior to issuance of the well construction permit. This requirement does not include those wells that will be constructed to conduct an aquifer performance test required by the district.
- A new well is proposed on property that may need a CUP, requiring a CUP permit determination and possibly a CUP, prior to water well construction permit issuance.

Wetlands permits streamlining
In December 2013, the U.S. Army Corps of Engineers (USACE) signed a coordination agreement with the St. Johns River Water Management District that authorizes the district to issue a permit on behalf of USACE for certain types of projects with relatively minor impacts to wetlands or surface waters. This expedites the permit process, thereby saving applicants time and money.
This authorization is limited to the following types of projects: 1) shoreline stabilization, 2) boat ramps, 3) docks, piers, and other minor piling-supported structures, and 4) maintenance dredging of canals and channels.
To qualify for a State Programmatic General Permit (SPGP), certain criteria must be met, including not adversely affecting threatened or endangered species, not being within specific natural resource management areas or within the federal channel. Other criteria that must be met are specific to each of the four types of projects listed above. For example, shoreline stabilization is limited to 150 feet of seawall or riprap, boat ramps are limited to no more than 50 cubic yards of fill, docks and piers must be less than 1,000 square feet, and maintenance dredging is limited to no more than 4,000 cubic yards. Additional criteria apply for each of the four project types.
If it appears your project qualifies for an SPGP permit, district staff will notify you and verify that certain requirements will be met, such as following the Construction Guidelines in Florida for Minor Piling-Supported Structures Constructed in or over Submerged Aquatic Vegetation (SAV), Marsh or Mangrove Habitat.

Tips on submitting compliance documents through e-Permitting
Did you know that all required compliance reports can be submitted electronically, even if the application was submitted by paper?
There are more than 50 types of compliance submittals, and any one of them can be submitted online. All it takes is an e-permitting account. After you have logged in, select the “compliance submittal” tab and enter your permit number, the desired date range or if the date is unknown, select no specific date, then click “submit query” button. All upcoming compliance reports due for that permit will be displayed. When uploading your documents, please be aware only certain formats are acceptable and are shown on the screen for your convenience.
A new enhancement is that you can now “sign and seal” your as-built drawings or any other compliance submittal document as you attach them by checking the signature file box or PKI Digital Signature box. The district received public comment asking for this enhancement.
